RIGHT TO MANAGE

Many leaseholders are unaware that if they are unhappy with their freeholder and/or the appointed managing agent, then the leaseholders can take control of their block. This Right to Manage (RTM) process is legally defined, but attention to detail and full knowledge of the legal stipulations are important. Otherwise reluctant freeholders can successfully object to leaseholders' claim to manage their residential block.

With our in-house legal counsel, we ensure costs are kept to a minimum, communcation is clear, accurate, timely and meets all legal requirements. We can form the legally required Right to Manage company, act as the Company Secretary, serve notices to all parties and manage the transfer of responsibility for the management of the block. We will also ensure Companies House and HM Revenue and Customs receive all the required information on time and to the correct standard.

We can either run the RTM process and then take over the running of the block, or when we have successfully obtained the Right to Manage, we can participate in the tender process for managing agents and hopefully then, take over the block management.

If would like to go one step further and purchase the freehold, then, we can arrange this as well.

You can find some of the detail if you download the Association of Residential Managing Agents' Right to Manage Guide (PDF). However, please get in touch if you would like to hear more precisely how we can help you take control of your own block.
